What does a boundary surveyor do, and is their report binding?

A boundary surveyor assesses documents and site evidence objectively. An ordinary report is an opinion; a private binding determination requires a clear agreement.

A surveyor gives a reasoned assessment of the evidence. An ordinary investigation report does not automatically bind your neighbour or change the registered title.

What the investigation can include

Depending on the agreed scope, the surveyor reviews transfers, conveyances, plans and historic evidence, examines relevant features and carries out a measured survey. The report explains how that material supports the conclusions and where uncertainty remains. Desktop work relies on supplied material; a site visit is included only where agreed.

Will the surveyor argue my case?

An objective report should assess material that weakens your position as well as material that supports it. Paying for the instruction does not make a preferred conclusion correct. A useful report helps you understand the risks before committing to settlement terms, building work or legal proceedings.

How can a private expert’s decision be binding?

Both parties can appoint one expert under a written agreement to accept the determination of specified issues as binding. The agreement should address scope, procedure, evidence, fees and the effect of the decision. This is a distinct service from buying an opinion, and the terms should receive appropriate legal advice.

What about a court Single Joint Expert?

A court expert provides evidence under CPR Part 35 and owes an overriding duty to the court. The judge decides the dispute. A court Single Joint Expert’s report should therefore not be confused with a privately agreed binding expert determination.

What should my instruction explain?
