An expert report explains what the evidence supports. If both neighbours want a binding outcome, they can jointly appoint one independent expert under a written agreement to accept the determination.

Independent boundary expert reports

We examine title documents, deed plans, historic information and physical features, then give a reasoned opinion on the boundary issue. A report can clarify the strengths, weaknesses and missing evidence before positions become entrenched.

This can support negotiations, mediation or advice from a solicitor. An independently commissioned report does not itself bind the neighbour.

From an expert opinion to a binding outcome

If both parties want a decision they have agreed to accept, our private joint expert service provides an alternative to litigating the agreed boundary question. Both owners sign an instruction giving one independent expert authority to determine the issue, with the determination binding under their agreement.

A shared investigation and focused procedure can be substantially quicker and cheaper than a contested court case. The timetable and fee depend on the scope and available evidence.

  • Review of deeds, transfers, title documents and plans.
  • Site inspection and assessment of physical and historic evidence.
  • Consideration of the competing boundary positions.
  • Reasoned conclusions, with uncertainties explained.
  • Annotated plans and evidence schedules where appropriate.

Expert reports for court proceedings

Where proceedings require expert evidence, we can consider a separate CPR Part 35 instruction. In that role the expert’s overriding duty is to the court. See CPR Part 35. A court Single Joint Expert supplies evidence; the judge decides the dispute. The private binding service uses a different instruction.
