A binding route before litigation
Where both clients are willing to submit a defined boundary question to one independent expert, a private binding determination can reduce duplicated expert work and avoid contested hearings on that question. The joint agreement should define the remit, evidence procedure, timetable, fee allocation and binding effect.

Useful documents at the outset
Please provide the title register and title plan for each relevant property, filed deeds/transfers, correspondence defining the dispute, photographs, plans, pleadings or draft pleadings if proceedings exist, and any previous expert material.
Defined questions produce better reports
Boundary cases can become sprawling. A clear letter of instruction identifying the factual and expert questions helps keep the investigation proportionate and the report useful.
