Bring the documents and the site evidence together. An accurate measurement of a fence is useful, but it does not by itself establish that the fence marks the legal boundary.
A sensible starting sequence
- Identify the relevant registered titles and obtain the available filed deeds.
- Find the transfer or conveyance that first separated the adjoining land.
- Read its wording alongside the plan, dimensions and named features.
- Collect dated evidence showing what those features looked like.
- Relate the evidence to the present site, with a measured survey where appropriate.
What if the documents are unclear?
An indistinct plan, missing dimension or changed feature does not mean the answer can safely be guessed. Identify what is uncertain and what further evidence might resolve it. Original copies, earlier conveyances or photographs from previous owners may be more useful than a new measurement of an unrelated replacement fence.
Must I commission a full report straight away?
Not always. If you have a focused question and a small set of key documents, an Early Neutral Evaluation can identify strengths, gaps and an appropriate next step. A developed dispute involving competing plans, alleged encroachment or a proposed formal application may justify a fuller investigation.
How can the result be recorded?
Once the evidence is understood, neighbours may be able to record an agreed line. A determined-boundary application is a separate formal route. Neither is achieved simply by drawing a line on a survey: the necessary agreement or application still needs to be addressed.
Prepare a clear brief
Mark the specific disputed section on a copy plan, list the documents you hold and explain what decision is needed. “Where is the boundary beside the garage?” is a more useful starting question than an unstructured bundle of correspondence about the entire relationship.
